Terms
Last updated: 5 May 2026. These terms apply to the Waylight Data v1.0 launch product and any custom build delivered under a separate quote referencing these terms.
1. Entity disclosure
During the pre-incorporation phase, the licensor of any sample, dataset, or custom build is Joshua Libeau Mowat (sole trader, ABN disclosed on the tax invoice issued at order). "Waylight Data" is the working brand name used for marketing, branding, and product identification during this phase. On incorporation of Waylight Pty Ltd (ACN pending registration), at or after the launch product hitting its go threshold, all licences and operations are novated to Waylight Pty Ltd. The refund guarantee in clause 4 covers any entity-formation risk in the meantime.
2. Compliance posture (buyer obligations)
The dataset is documented per row with source_url and consent_basis. Buyers using the dataset must comply with:
- Privacy Act 1988 (Cth) and Australian Privacy Principles, in particular APP 6 (use), APP 12 (access), APP 13 (correction).
- Spam Act 2003 (Cth), in particular s.16(3) conspicuous-publication exemption applicability per row, on the basis published in consent_basis.
- Do Not Call Register Act 2006 (Cth) washing requirement before any telemarketing campaign.
- Health Practitioner Regulation National Law: AHPRA fields are due-diligence-only, not for direct marketing.
- Trade Marks Act 1995 (Cth): AEP, AES, CPSP, MFAA, FBAA, and similar registered marks are not licensed for buyer marketing use.
- National Code of Conduct for Health Care Workers (where applicable to buyer activity).
3. Warranty and limitations
Every row at delivery passes a 10-point QA acceptance rubric, with last_verified date stamped. Email validity is verified through MillionVerifier at delivery. The dataset is provided as-is at the last_verified date. Practitioners and clinics change details over time. Waylight Data does not warrant currency beyond the stamp. Australian Consumer Law non-excludable rights stand regardless of these terms.
4. Refund
Full refund within 48 hours of request if the pre-sell window misses its go threshold. Full refund within 48 hours if delivery exceeds the promised 10 business day window by more than 3 business days. The 30-row redacted sample is yours to keep under any refund scenario. No partial refunds after delivery, except where required under Australian Consumer Law.
Nothing in these terms excludes, restricts, or modifies the consumer guarantees in the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) where they apply.
5. Licence
Per-buyer licence: the dataset is licensed to the named buyer entity for use within that buyer's outbound, sales, or research operations. The dataset may not be on-sold, redistributed, or hosted on a third-party platform that would expose it to parties other than the named buyer. Contractors of the buyer working on the buyer's campaigns are within scope.
6. Cap and exclusivity
Waylight Data v1.0 is sold to a maximum of 10 lifetime buyers. Once 10 buyers are onboarded, v1.0 closes and no further copies are sold. v2.0 (a fresh scrape with new sources, new validation, new last_verified dates) opens approximately 6 months after v1.0 closes, with new pricing.
7. Custom builds
Custom builds are quoted off-menu against your filter list. Pricing per the public tier table on the home page (simple, standard, compliance-grade, premium). Minimum order $1,500. Custom builds are not bound by the v1.0 cap. Each custom build is a separate engagement under these same terms, with the buyer-specific filter list attached to the quote.
Volume builds (the Directory tier) are a separate category, not a fifth custom-build tier. Volume builds carry less verification depth than the custom ladder (no register-membership cross-reference, no AHPRA cross-reference, no MillionVerifier per row) and are scoped to non-regulated industries only. Regulated verticals (allied health, accountants, migration sponsors, healthcare) are excluded from Volume builds and only deliverable under the Launch Product or Compliance-grade custom build tiers. Volume builds are $2.00 per row with a $1,500 minimum order over 750 rows, delivered within 5 business days. Same per-buyer licence (clause 5), same warranty (clause 3), same buyer compliance posture (clause 8).
8. Buyer compliance responsibility
Every row in any dataset (Launch Product or custom build) ships with documented source_url and consent_basis. This documentation is what allows the buyer to rely on the Spam Act 2003 (Cth) s.16(3) conspicuous-publication exemption for electronic messages, and to demonstrate lawful and fair collection under Privacy Act 1988 (Cth) APP 3.5. Once delivered, the buyer is solely responsible for: (a) Spam Act compliance on each commercial electronic message sent to a row in the dataset, including consent and unsubscribe handling; (b) Do Not Call Register Act 2006 (Cth) washing before any voice telemarketing; (c) Privacy Act obligations for the buyer's own collection, use, and disclosure of the dataset post-delivery; (d) AHPRA register-data due-diligence-only restriction (no marketing use of AHPRA fields). Waylight Data warrants the lawfulness of the source pathway. Waylight Data does not warrant the buyer's downstream messaging compliance.
9. Governing law
These terms are governed by the laws of Queensland, Australia. Disputes are subject to the non-exclusive jurisdiction of the courts of Queensland.
